It was the Telecommunications Act of 1996 that you are referring to.

It makes a distinction between ISPs, who provide access to the Internet for end users, and common carriers who provide access to the public switched network. This is the little clause that keeps the ISPs in business by exempting them from paying access charges to the carriers for connection to the lines into your house (nice subsidy if you can get it, and they did). Of course, the incumbent carriers continue to cry foul, that everyone else especially long distance carriers have to pay access charges, so why not the ISPs? An ongoing battle.

Now, add one of these cute programmable switches and SS7 to the mix of the ISP who now can provide voice services over the Internet to become an ITSP. Starts to look a lot like a common carrier doesn't it? They are still providing access to the Internet, but also connect into the public switched network via gateways and all that, with full feature functionality of the public network. Could be considered a CLEC (competitive local exchange carrier) instead of an ISP. And CLECs are under the eye of the FCC and their regulations, although not as restrictive as the Bells must adhere to.

Just thought that might clear things up a bit. Or did it make it worse?
