I've run into a problem with Datek. Yesterday, I cancelled an order to sell some shares and received a confirmation message back that I was out of the trade. Today, I received word that the trade had executed this morning and that the shares were sold. I called Datek to inform them of the error and get it corrected. (At the time I called they could have bought the shares back at no cost since the ask price was the price they had sold the shares for). They kept me on the phone for over 30 minutes while they were "looking into it". They came back and said they were still looking into it, but to consider the shares sold.

To me, it seemed pretty simple. I'd delivered instructions to cancel the trade and received confirmation back that I was out of it. So if a trade executes after that, it should be up to them to rectify it. Thus far, Datek's customer service around this has seemed abysmal.

Two questions:

1. Has anyone else had similar experiences with Datek?
2. What remedies are available to address the situation?

Thanks,
Baird
