While it's true that "shorting against the box" still allows locking in profits while providing tax deferral (Clinton want's to close that loophole, but so far he hasn't been successful), there are reasons people won't do it. First of all, the average "small lot" guy doesn't even understand it. Second of all, if you use a "fool service" brokerage, you'll pay huge commissions. Even if you have SHORT TERM gains in 1996, by waiting until 1/2/97 to sell, you defer the tax due (in most but not all cases) until April 1998. So, you're right, the sellers are loathe to do so until after the first.
