I would agree, and looked but could not find the answer. It could be either. If they still list the A/R under dispute it would seem unusual, and if it is not included in this A/R - this A/R looks fishy to me.

As for as info on the Conv Pref. - look in the May 15 8k

It has the terms. Note the terms allow lowering the price of conversion if any other stock offering is made...
