To Datek: Tracking#: D-100-AAAE-9012

I submitted a short-sell market order today for AND at 11:51:53 - bid at approx 6 3/4; it remained unfilled until 12:43:40 at which time you filled it at 5 3/4. Within a minute of filling that order the bid was back up to 6 1/4.

I think the implications of this are pretty obvious. This is not the first time this type of thing has happened.

I have sent email regarding this matter to trades@datek.com. If the trade is not either negated or entered at the original bid, I will be reporting the matter to the SEC - and looking for a new broker.

I may be reached at rickf@minn.net
