In Thursday's hearing, Judge Jackson also handed the government victories in two pretrial disputes. He ordered Microsoft to make Mr. Gates available for whatever reasonable amount of time the government needs to interview him; the company had sought to limit Mr. Gates's testimony to eight hours on Aug. 12. He also ordered Microsoft to turn over its secret "source code" blueprints for its Windows software, overruling Microsoft's request for added protections to guard its trade secrets.

"I don't intend to place a time restraint on Mr. Gates's deposition," he said, brushing aside Microsoft's request to limit his testimony. At the same time, he said existing court-ordered confidentiality agreements were sufficient to protect the Windows source code; Microsoft had sought to bar the government's expert witnesses who review the code from working on operating systems for a year and for any Microsoft competitor for 18 months.
