I think the eventual outcome depends on exactly what the SEC finds and how serious they consider it to be. They could also choose to bring charges against people involved with the company. I believe the suits in question are invariably civil, and may result in fines and suspension from working in the financial business in future. Check out the SEXI case for an example; or SKYS.

I think that any charges of criminal fraud, if contemplated against all or any parties to this mess, would have to be brought by local authorities. If violations of Federal law are suspected, I suppose the FBI might take an interest as well.

Usually the most that happens is that the principal miscreants settle with the SEC and are heavily fined. Generally the company is put in the hands of an administrator in these cases.
