Is Gates Meddling with his Lawyers?

I still don't understand what's going on with Microsoft. Why are they using their legal briefs for a PR offensive? Is their case really that weak? I can only think of a couple of possibilities:

1) All the lawyers which say Microsoft is using this as a PR offensive and doesn't have a case, including the DOJ and 20 States, are wrong.

2) Microsoft lawyers are just not that good. Don't laugh, it happens.

3) Microsoft's case is so weak that they're throwing whatever they can in the briefs hoping to change the public mood to be in their favor. This makes little sense to me. The right thing to do here is to have an advertising campaign like the Tobacco groups did to energize Congress. Meanwhile, play down your legal briefs in the media and just argue the law.

4) Microsoft somehow is hoping that the force of its rhetoric will resonate with the Appeals Court which they hope is sufficiently activist conservative to just throw out everything later no matter what the law is.

5) Bill Gates won't let his lawyers do their job and insists on putting things into the briefs that they shouldn't. The lawyers are afraid of him and just do what he says. Note that this is actually a specialization of #2, "lawyers aren't that good," because a good lawyer will protect a client from himself. Of course, if they were that good, Microsoft wouldn't be in the trouble it is in today.

My guess is some combination of 2 4 and 5.
