*AV*--NVLS doesn't exactly have a good track record with lawsuits such as this<GGG>. I think there is some merit but that the lawyers are going to bust chops on this one. this is too critical an issue for NVLS to walk away from. This is a linchpin for their copper technology offering to compete with AMAT.

I also think this is a defensive move on the part of SMTL. This downturn has hit them hard along with other companies. I strongly beleive that if it looks as if there is some merit to this, SMTL will be taken over by either NVLS or AMAT. NVLS almost has to go after SMTL if it looks as if things are not going to go their way. However, with $1.6 billion in cash reserves, AMAT could clean NVLS's clock by taking out SMTL and placing a world of hurt on NVLS. SMTL is sitting in a catbird seat now and if they are convincing, they stand to make a great deal of royalties or command a premium as a takeover candidate.
Heaven help us if we get into a bidding war<GGG>.
