Does this president forfeit his or her right to
silence the critics. If we assume the critics are the ones who lost the money that the
insiders made, do the critics not have a right to complain?

A hypothetical answer to a hypothetical question!

In a law abiding society the president and Co. give up the rights to silence the critics. The critics have a right to express opinions and concerns in any forum they chose. This is a given in my books.

You must understand that the game is really fixed in the companies favor. Options can be repriced at any given level. Shares can be rolled back at any given time. Preferred shares can be issued over common shares that the general public gets. Financing and dilution can take place at practically any level. Shares can be given away to PR people. Shares can be used to settle debt. Etc. etc. etc.
