The contract is chock full of confidential information like royalty rates and so forth and is subject to a non-disclosure agreement (which it appears that ETRI violated). Qualcomm has avowed not to similarly violate the non-disclosure...so I have to rely on management's explanation.

In the United States, the primary difference between cellular and PCS is the frequency, with for the former is at 800mhz and the latter at 1900mhz. My strong suspicion is that the Qualcomm/ETRI contract delineated a specific frequency (i.e. the cellular band). I suspect, although no one at Qualcomm will give me this level of specificity, that this specification was determined to separate cellular applications from wireless local loop. Regardless of how and why, QC is emphatic that the contract, by its terms, includes only cellular-band products.

To my knowledge, if two parties are of age and enter into a contract without duress, it is not incumbent on one to explain to the other the contractual specifics. Have a nice weekend!
