Interesting Analysis, Skeet.

If correct, it might be difficult to prove in litigation.

But the end result certainly means the bondholders will do everything possible to insure the company doesn't default on those notes.

And it has given someone an excellent opportunity to acquire shares of this company at bargain basement prices.

Of course, a class action suit could possibly exact the appropriate revenge upon those who expect to gain from this debacle. And I don't normally beleive in spurious shareholder suits, but this one seems justifiable given the obvious lack of disclosure or prior warning.
