As for paper patents point I disagree. First because a year and a half ago Ericy was on record saying CDMA didnt work, it was a sham etc etc etc. Whille at the same time Qcom had an open system working. These patents are the same as many CDMA2000 patents.
To undestand my point, you need a background in Intellectual Property. The process of getting a patent is that you just need one element and it doesn't matter how small to prove that it is a novel idea. For example, there are a multitude of patents on Analog to Digital Converstion, Variable Bit-rate Coding (some of those are held by Jacobs), Home Location Registers. Just b/c someone comes up with an idea for any of those, or any other ideas, doesn't mean that someone else can't either. They need to find a different implementation
As for patents, I think ERICY can get whatever type of coverage they need. There are many ways to get from Point A to Point B. HOWEVER, their problem will come in the implementation. For example, MOT licensed QCOM's patents. HOWEVER, they are having a problem making CDMA phones.
