Not all Qualcomm patents pertaining to IS95 have the word "CDMA". If it can be applied to other modulation methods, why limit the scope of the patent? Considering that Gregg Powers is Q's largest institutional investor, I trust his research. The cost of the patent research pales in comparison to the size of his investment.
