Sorry, it was late last night, I made one error. I thought that this

that you posted was just the abstract. Now I check it properly I see it is the whole article. Lying in bed I was puzzled how Edderd could know that Vivus were not acknowledged just by looking at the abstract. Normally, I get journals from the libary and was surprised that you found a site where it is possible to read entire articles for FREE without subscribing to this journal. Most journals you have to subscribe online.
YES this aricle has now been published so anyone can do anything they like. There was only a problem for me if I were identified as the source of unpublished material from page proofs without the permission of the author. This no longer applies.
This again is the relevant passage from Dr Christ to me,
"Yes, I can indeed confirm that I have a formal relationship with VIVUS. I am a consultant for VIVUS and I am very much involved in their gene therapy program. We are currently in the process of conducting the preclinical studies required for decision making, more than that I cannot tell you. However, based on the published data I share your enthusiasm, and I am, therefore, optimistic about the possibilities." Remember at the CC, there was mention of potassium channels, so presumably Vivus is helping to take forward this particular approach.
As I said before, I think that Vivus have come into this work quite recently. It is clear that they did not fund any part of this recent published work by the Albert Einstein group, else they would have received acknowledgement in the paper. However this does not rule out a Vivus press release to coincide with the publication of the paper, the spin could be that Vivus have signed agreement with Albert Einstein to take forward exciting results recently published in Journal of Physiolgy..blah, blah, blah.
Well since the paper is published now, Vivus are biding their time. Perhaps they plan to announce the gene therapy work, domestic partner, more EU approvals, and Q3 earnings surprise all in the same press release.
