Slvfx, the reason that "The Office" looks like the MBE Business Express is because it basically is, hence the lawsuit. AlphaNet agreed to enter into a business relationship with USA last summer. Basically, they would play a role in placing the business centers in hotels, etc. After having seen confidential marketing and operational information, it is alleged in the lawsuit that AlphaNet terminated the relationship, and not long after, began marketing "The Office".
However, they are not a threat to USA/MBE. First off, their unit is activated by debit card or smart card, meaning you have to pay (cash or credit card) to get a stored value card with say $10 on it for use towards The Office. Well, what happens if you only use $4 of that card? Then you are stuck with a debit card usable only at The Office locations, all 30 or so of them nationwide. Secondly, Sir Speedy is absolutely no match in name recognition or marketing muscle for MBE, and thirdly, AlphaNet does not have an IBM financing inventory, installing, servicing, maintaining and assisiting with worldwide marketing efforts.
As far as an immediate injunction? I honestly don't know, but I tend not to think so.
Tom, 4th quarter ended March 31. Many companies have their fiscal year coincide with the calendar year. Many comnpanies don't. USA is currently in the first quarter of Fiscal Year 99. I spoke to the company today...I would expect numbers within 3-4 weeks. |
