I have to disagree with your assessment of the filing.

After stating that "The Company does not believe that it will return to profitability in 1998" we either assume this either means fiscal 1998 or the remainder of 1998.

The same sentence goes on to explain reasons that are past not current factors that created losses in Q1 and Q2 as it goes on to say, "due to a number of factors including costs associated with the restructuring," a thing of the past in Q2 "domestic and international competition from Pfizer" a thing of the past and present "and manufacturing difficulties." as I understand a thing of the past.

I think someone should call Vivus and discuss this sentence and the last 2 sentences of the 7th paragraph as it seems to me that it is rather unclear whether these statements are predictions of future events, explanations of past events or just broiler plate statements designed to cover the Company in case things go worse than expected.

I know of many companies that always paint a grimmer picture so that when results are disclosed things always look better than expected.
