The P itself is not required. The fact that this is a penny common ("C") stock with a "P" that in most cases was pricey enough to fulfill the criteria for listing is what potentially makes the structure work. A "P" of 3 1/2 such as we have seen won't do it, of course.

Remember the P was over 25 per share while the C was in the dollar range, the latter also not enough for NASDAQ.
