Cosmo, I admitted I didn't know much about this area of the law, and it's becoming more and more apparent. So how does libel and slander fit into all of this? Aren't I protected from a lawsuit if I publish an opinion? Or if you "overhear" my opinion? I thought that opinions are protected from private lawsuits by the First Amendment. No?

And does the Internet change things? Posting to SI for all to see is a unique form of communication that wasn't anticipated by the framers of the Constitution, nor in most of the classic First Amendment cases. It's a mixture of conversation and publication, as you know that anyone can "eavesdrop" and continually refer back to the published conversation.
