This is a very interesting question. Should the President be treated in a different manner by the law than are "regular" citizens.

Another question for you - when you describe the investigation as a fishing expedition, you assume that the prosecutor doesn't know what he's looking for. Yet you don't make that distinction in the organized crime cases. If it really was a fishing expedition, I agree with you. If, however, Starr "knew" the President was dirty (ate Christian babies, actually liked Tofu, etc.), would Starr be justified in fishing for whatever it took to take the man down. Please note that I am not saying Clinton is (or is not) guilty of anything - I only want to know if there would ever be justification for going after a President for little stuff.
