<<Fruitless? Want a bet?>>

I would love to bet. Jones is appealing a sexual harassment case to one of the most conservative Circuits in the US Courts of Appeal--the Eighth Circuit. Judge Webber Wright was right on the money in her decision and squarely down the middle of the way the law applied in the Eighth Circuit. She found that Jones was wrong because (1) a single incident of a crude come-on cannot constitute harrassment under Title VII, and (2) Jones raised no genuine dispute of material fact over the question whether the Governor caused her any employment detriment. I don't see how Jones wins with those two decisions. As for the other less central claims (wasn't there an intentional infliction of emotional distress claim?) I don't think she put out enough allegations to raise a material fact. In that type of decision, the trial court is normally granted a huge amount of deference.
