Winzer - is it possible that EXL still had some production sold forward and they are able to realize a higher price for their part of the production? I hear from sources (GME) that we are still running about break-even mining the development ore. The JV dispute will go before the referee next month from what I understand.

Perhaps it would not be a bad idea for someone to give EXL a call and see what they have to say about this.

CLK has a good point about the rev's, it would appear they are not frozen by the court. However, it does puzzled me as to why EXL is in a plus cash flow position and they are not able to pay Battle Mountain the NSR in question.

Hopefully all of this will be cleared up over the months ahead.
