Mr. *UKE thinks the SEC is considering the type of charges companies take when writing off expenses associated with acquisitions and that is factually correct - probably - but the fact is no one has accused anyone of violating GAAP standards in such writedowns. Since the governing body for CPAs and Auditors hasn't taken a negative position on these special one-time charges (at least not with respect to the kind MRVC has employed) the SEC may have a fight on their hands if they propose to ban them.

Taking an assertive accounting stance where there are no contrary rules via GAAP is the same as taking an assertive position with the IRS - perfectly legal but you run the risk of being overruled. Under no circumstances is that FRAUD. What is fraudulent/flatulent is *UKE's assertion that MRV's management commits fraud or fraud-like accounting practices.

IMHO, of course. Put that in your operatives and agents and smoke it!
