Assuming that AFFX can both practice and enforce its broad patent on high density arrays, it seems to me that they have a controlling interest in this high-throughput technology. Of course, one must still be able to manufacture and sell the product at a profit.

Certainly, being one of the first companies in the industry gives AFFX the strength of an established patent portfolio. I feel that the HYSQ patent disputes are what are now holding AFFX back. HYSQ has a relationship with Perkin-Elmer (PKN), which gives them some strength in defending their position but from what I have been able to assess, the technology covered in the HYSQ patents is not dominant over that of AFFX. It now appears that it will be at least a year before the HYSQ matter will be resolved. In the meantime, AFFX is establishing new manufacturing facilities to cover what has been reported to be a backlog of orders.
