Your facts aren't straight, RON. You only have to trade above 1 and meet certain capital asset requirements. It is necessary to close at $4.00 for 10 consecutive days to GET onto NASDAQ initially but not later. I went through this with ROTI about a month ago.

Besides if you read their filings or call Norman Muller, you will find they already met with NASDAQ and are not going to be delisted. Call Norman Muller if you have any concerns.
