True, but as you point out the opportunity to cash in would require very fast execution. It's likely to differ only in the gaps between trades of one stock or the other.

You've mentioned Burgess and his shares a few times recently, and I'm curious to know if it is confirmed that he still holds the shares.

That could also be because the share structure gives ESVS controlling votes in this, and it would have been for naught anyhow.
