So if you're willing to pay the commission and maybe a 1/16, you can still "short" on a down-tick?

Yes, if the spread is 1/16 or more, you can short on a down-bid at a price of bid+1/16 or more. If the spread is less than 1/16, you can short on a down-bid at the ask or more. Both assume you can find a buyer at such a price of course.
