Yes, Lucent is technically independent but that's almost like saying that Bill Clinton didn't legally have "sex". Lucent has deep, deep ties with AT&T and it hasn't changed since the spinoff. Did you know that TLAB doesn't do any business with AT&T either? I've heard other companies are having great difficulty breaking into AT&T. It's not really surprising that CIEN still didn't get in. I think Wall Street was way more optimistic than the two companies were. My sources tell me that the Lucent people HATE, HATE, HATE Pat Nettles at Ciena. It has been characterized to me as a personal grudge and not a normal business relationship.

The class action lawsuit is normal and won't amount ot much. Frankly, I'm surprised we haven't seen a lawsuit against TLAB yet. I suggest we may see one against AT&T and Lucent shortly too. Lawyers will be looking for any angle on this one. Bottom line: the lawsuits will not enrich any of the classes except the lawyers.
