Clark, usually at the end of a disclosure, the applicant writes that modifications of the patent would not diverge from the scope of the invention. The question would be, how obvious to one with ordinary skill in the art would it have been to use that system in a different standard. Furthermore, if the scope of the claims mentions IS-95 as a limitation, then the Q's protection would only be in IS-95 systems.
