At this point, Charles, the decision to litigate and the defense and the costs thereof, is usually in the hands of the insurance company providing securities litigation coverage. Their willingness to continue into court may NOT be good...as it implies that they feel they have a good defense. And a win in a case like this mitigates the damages of the publicity.

At this point all that we can tell is that this is now in court...not which party - and it could have been either - determined to place it there.

And the defendants have an advantage, as they can wait and let the SEC do the discovery for them in the SEC case.

But, Charles, this is much appreciated coverage and news! Thank You!

It would be great if you also have access to, and can also post, the response in the SEC case which you referred to in your first post - presenting the case for Bill C, etc. While I have been a critic, it's only fair that their side of the story be presented and available to those interested.

It would also be useful to see what the defendants' response to the complaint is in this case, when that becomes available, if you have access to and can also post that.
