I see in the Sept.96 - 10Q that Visx filed an answer to the suit in
October 95, but I have not heard anything on the resolution of the claim. I would be surprised if the Feds would allow Summit to stand alone in the field. I think they would work a deal to place any patent use considerations into the Pillar partnership where all the other common patent reside. ( Get ready for more law suits from other companies)
Let me ask you something. You say Visx is the better deal. It is my
understanding that Visx intends to make its' money from the sale of
machines whereas Summit has a different plan. The Visx machine,
I'm told, cost about $200,000 more than the Summit laser, and now
that FDA has allowed trials for farsightedness for the Summit machine,
is there $200,000 worth of difference? Also, I saw an analysis which
listed the positives and negatives of each company. It was noted
that there may be a glut of lasers if the technology becomes common.
The competition would drive the price down. Summit says they will
prevail because they sell machines, collect revenue through their
own centers for the surgery, collect revenue from Pillar, service the
machines, and sell the mask developed by them to be used each
time their machine completes an operation.
I am curious what you and others here would say to all this. Also,
was that price quote correct as to the cost of the machines.
