The reason it wasn't proven was he confessed before proven. Kind of like "you can't fire me, I quit!" Nothing can be proven until the report comes out(unless he starts confessing again). I seem to remember when ML's accusations were nothing but ridiculous claims from a lovesick Clinton stalker. This was shown to be lies even before the report came out. The dress hasn't been verified to contain Presidential residue, but by this time there is very little doubt that it will be. The closer to the corner you run, the less escape room you leave yourself.
