Short v. Box to avoid uptick rules = Violative Notice to Members NASD August 1998. Notice 98-65 NASD Reminds Members of Obligations Relating to Short Sale Rule Some key wording - "It has come to attention of NSD that NASD members may be assisting customers in circumventino of Short Sale rule...failing to net security positions....maintain accounts in their name and exercise control over a second related account.." "required to net all positions for accounts that are related or under common control" Thats it..short v. box to hit downbids, ticks is over. Make sure your b.d is aware, if you like them.
