I think Intel can easily show that servicing DELL's JIT costs them more. An example would clearly be shipping. 80 shipments a year will cost more than 6 or 8 large ones...including shippers, packaging, etc.. Also, other arguments regarding inventory will easily hold up.

Look, I live in the bay area. We pay $1.20-$1.25 a gallon for regular gasoline. They're paying less than $1.00 on the east coast and much of the oil comes from the west. THAT is price discrmination and the FTC does nothing about that.

As for Intel being a monopoly - 2 years ago I would have agreed. Today they're getting their lunch eaten on the low end. They are in a competitive battle now - a monopoly doesn't worry much about competing.
