I am not arguing the validity of the Q's patents. I appreciate the history of spread spectrum, but I am fully aware of that. One thing I don't understand is your comment:

The ETSI is trying to come up with different ways of using CDMA. When someone has a solution and is demanding exorbitant (in the licensee's view) royalties (However, any royalty may be contrued as exhorbitant, but I am not arguing that) different implementations occur. Look at Intel with Slot 1, AMD has come up with Slot A. Cyrix with their Media GX? IBM with their MCA bus? Rambus with their RDRAM design?

When an entity demands a royalty(exhorbitant, or not) off of their IPR, they run the risk of alienating the market.
