Misonix says court denies injunction

FARMINGDALE, N.Y., Sept 14 (Reuters) - Ultrasonic and air pollution systems maker Misonix Inc. said Monday a court has denied a preliminary injunction motion seeking to bar the manufacture and sale of its LySonix 2000 Ultrasonic Soft Tissue Aspirator.

The company said the U.S. District Court for the Central District of California on Sept. 11 denied the motion brought by medical products company Mentor Corp. against Misonix and licensee Medical Device Alliance Inc. and wholly-owned subsidiary LySonix, Inc.

Mentor Corp., which first sought the injunction in January, was not immediately available for comment.

Misonix has said the injunction request was an outgrowth of a suit Mentor filed in May alleging patent infringement with regard to the LySonix 2000 Ultrasonic Soft Tissue Aspirator.

Medical Device Alliance and LySonix were originally named in the patent case and later the suit was amended to include Misonix, the company said.

The company said Monday the court restricted certain of Mentor's claims with regard to the scope of its patent and interpreted them consistent with the Misonix interpretation.

Joseph Librizzi, the company's president and chief executive officer, said the company will continue to contest Mentor's suit and expects to go to trial in January 1999.

Misonix's stock was up 1/2 to 7-1/4 in morning trading on the Nasdaq Stock Market. Mentor Corp's stock was also up 1/2 at 13-1/2 on the Nasdaq.
