I've posted a bit about Ebay... I also use there service to buy and sell...

In one instance I returned to the seller three items that were misrepresented in an auction as paintings when in fact they were photographic images highlighted with paint... Anyway.. I followed the "terms" of the "auction seller" and returned the three items... The amount I paid was ~$550.00... Well to this day I have yet to get a refund... This originally happened over six months ago... I've done every thing the auction seller has asked..he has always said he would give a refund, but really just keeps delaying.. I'm really not sure what his intentions are....

Well... I've recently been in contact with a few others who are having similar problems with the same seller... and will include an E-mail I just got from one of them.. It is interesting because of the "tone" of it..which I think reveals the type of problems that Ebay may face..

A class action should be filed on behalf of all ebay users against ebay for fraud, bad faith and conspiracy asking for actual, special and punitive damages. Lawyers are now studying the matter. ebay's so called "user's agreement" may be in violation of the auction laws of several states, including California, New York and Alabama. I'm prepared to take a loss on this item if I have to..not really a huge deal to me.. I will continue to use the methods Ebay has set up to deal with problems...

I know Ebay has received a number of complaints about this seller... It seems that Ebay is the only party that can really prevent potential abuses of these "auctions" and try to follow the same rules which govern "real" brick and mortar auction houses...

I really think this is potentially a very serious problem for Ebay.. there is some real scamming by some sellers... And I think the scamming will get much worse...

This message is just to promote thought and exchange... I personally like Ebay and will continue to use it...

We kind of discussed this a week ago or so... the real question to me is... whether the normal rules governing an "auction" will apply... Who is the "auctioneer"? Ebay or the Seller???

Addition..was just scaning Ebay...here is another interesting thing one finds on e-bay... Requiring MO or cash... Wonder if he is trying to hide something.. ;-)

High bidder pays postage and agrees to pay by US *POSTAL* money order or cash. If you can not pay by a *POSTAL* money order or cash please do not bid. Foreign bids will ONLY be honored if payment is made in cash.

Really points out the "income" and tax issues (income and sales)... or potential for a scam..
