That standard was intentionally left vague. Without definitions or commonly understood usage, the terminology in the standard is less than useless.

I disagree. Laws are passed every day with nary a thought to the framers' intent, and the Supreme Court upholds them frequently. There is no requirement that the framers' intent be considered. For that matter, the Supreme Court was not envisioned by the framers to be the arbiter of the constitutionality of state laws, but it does so anyway. If the Congress and Senators act within the letter of the law, they are acting Constitutionally. They are also acting immorally and unethically, but that's nothing new for them.
