I actually hope its neither, that all the buying has been occuring due to macro conditions -- flight to quality type stuff. I think that MO's hefty dividend, its solid earnings, the shaky global markets, political weakness all over the place, MO's strong fundamentals and its recent string of victories have prodded many investors to change their view of MO. It is a perfect defensive play. If this is the reason behind the buying, then the news of the settlement will have a strong pad to launch from.

Regardless, the real breakout, I mean REAL, will occur with the actual news of the settlement. IMHO there is no way that a settlement will ever be fully priced in to MO, even after one is announced, thus we have room for substantial upside.

Looks like she's holding together today.
