On the issue of whether Clinton committed perjury both before the GJ and in the deposition over the issue of touching, let me correct a false impression I may have given. I think Clinton probably did lie about this, on a more likely than not standard. I think in an actual jury trial, he might well win on a beyond reasonable doubt standard, which is what I had in mind.

In fact that standard, in all its operation (including certainly unanimity), will not obtain in the Senate. So I think Clinton is likely to be considered guilty on that single count at least, in the two forums. Civil deposition and GJ testimony.

I continue to think that not enough to amount to a high crime, under all the circumstances.
