Washington Update --

The Senate bill falls short of expectations. It has a "reach back" provision that is supposed to extend the bill's protections to those companies that have been sharing Y2K-related info all along, but in fact it provides substantial loopholes that will benefit the litigators. Hence, those companies that haven't been disclosing info re their Y2K-readiness -- for whatever reason -- receive greater protection from frivolous lawsuits than those that have been disclosing. And the Senate is controlled by Republicans? Go figure.

I have recommended that my organization stay neutral re S. 2392. A major disappointment. I will raise this issue at tomorrow's first meeting of Koskinen's IT-sector working group.
