Aren't delayed trades free with DATEK?

If your marketable order doesn't execute within 60 seconds, then the commission is waived. So says their web page. Of course, if the trade did not occur because of their slowness ....

Also, the last time I tried to get my commission waived, they said the 60 second clock starts from when the order processing begins, not from when your order is entered. As an example, today I entered an order at 09:58:15, but the processing of the order did not begin until 10:00:41. The order was filled 30 secs after that. I'm hoping they've changed their policy to a more reasonable "60 seconds after entering your order".
