No, but if CSCO was in talks with CIEN it would be inappropriate to say it has several shortfallsthat prvent it from being an ideal acquisition candidate. That would border on manipulation, and at a minimum would not be seen as fair. Certainly it's a material fact and would have to be disclosed at some level if they were in discussions -- it could have been a noncommittal "we talk with a lot of copanies at all times, but if a deal were done or we were in serious discussions we would reveal that. That is not the case with CIEN"

So Chambers had other options beside what he chose to say.
