It does seem strange for Intel to take a stake in Micron, but
the timing is right for an investment. INTC is up, and you can't buy your own on an uptick, while the memory industry is closing down excess capacity (~40%) pretty fast. Micron is going to be a major player, after Samsung and the other Korean combo. Intel bought into Samsung's Texas fab (and I haven't heard what happened to it -- but it would be idiotic to finish or enlarge it now). I don't think there is any DOJ problem as long as Intel is only buying a minor investment and not exercising any control.
