Ian, The settlement with Creative has to be the reason for the 23.53% gain yesterday. The news was not released until 8am today. Apparently there were people who know the settlement yesterday and rushed to buy the stocks. I can not explain why otherwise 5 times of the daily average volume was executed yesterday. The settlement spells relief to investors because a lawsuit hanging overhead is the last thing they wanted. Creative has sued ESS Technology, Diamond Multimedia and Aureal Semiconductor for the infringement of its patent.--- I guess it has something to do the audio technology.--- who can explain the financial consequences of this settlement? For example, does ESS have to pay some money to Creative? If yes, is it one time payment? How much? Hopefully the analysts should ask the company in the coming October conference call for the Q3 quarterly report. Hopefully we can figure out the value of the settlement. R.
