Yep one can patent genes, that has been a standard for many years. However, everyone gets a royalty free license to utilize the genes for personal use in a non-commercial manner ie.) in one's own body. Your kid will also get its own license. However, don't try and isolate the gene from your kid and use it on yourself as that would be a clear case of patent infringement.
