It seems to me more than a little selfish to forbid Native Americans or other Aboriginal People to exploit the resources of the limited properties that imperialists have left them, especially when the rights are guaranteed in treaties which the imperialists forced them to sign and reserve the right to adjudicate. You can be sure that if there were no treaty rights involved no one would give a damn. A Native Hawaiian was fined and imprisoned by Federal court for killing a seal, despite his arguing that it fell within Native gathering rights that have been upheld by the State Supreme Court. If the outcomes are environmentally unsound, then the government involved and the People in question should negotiate a change. I think the reason some people don't want this approach is that it would be very expensive if the People were advised by decent lawyers. The people of Hawaii are paying hundreds of millions of dollars in negotiated damages to the Hawaiian People for lands that were guaranteed them in 1900 and of which they were deprived by the Federal and State government. Peace and Justice are not Free. For white Americans to define the rights of Native Americans to satisfy their own needs, especially newly discovered environmental needs, smacks of more than hypocrisy -- it smells of theft.
