This is kind of funny to me.
I, being a broker, am not surprised.
If a client looses money for any reason, the broker or the broker dealer often looses the case. Settlements are common.

My big question to the courts is:
When are the courts going to pass legislation that says that an individual is responsible, and the institution is not responsible for a loss that occurs.

My best guess on the answer:
After the market crashes and every one looses 50-70% of their money.
There will be all kinds of law suits. I bet some one ends up getting money they lost from a short seller that made money on the same decline.
I hope that does not happen, But that is how friendly the courts are to folks that loose money
