The landmark lawsuit would begin on Monday, October 19, if Judge Thomas Penfield Jackson agrees to the request, according to sources close to the case. Microsoft has already agreed to the Justice Department's proposal, sources said.

Late this evening, a Justice spokesman couldn't confirm the department had made the request. A Microsoft representative declined comment.

The principal effect of the trial's delay would likely be to push back pre-trial deadlines by four days. Written testimony of witnesses is due on Friday of this week.

The case has already been delayed once, pushed back three weeks in mid September at the request of both sides.

When MSFT turns up for Earnings, it will be with a vengeance.
