Timothy, negatory good buddy!!!! Either we interpret the law differently or you are wrong <ggg>. I can tell you that I have done this many times and it has survived an IRS audit. If time is of the essence, there are other tricks to avoid wash sale rules as well. One unfortunate guy I know wanted to take the tax loss on his Western Digital stock, but didn't want to sell. So he sold Western Digital, bought an equal amount of Seagate, then after 30 days sold the Seagate and bought his WD back. The only thing I found wrong with that strategy is owning disk drive manufacturers <gg>.
